Council

That the council agenda dated December 6, 2022 be approved as circulated.

That the consent agenda items 6.1 to 6.28 except Item 6.17 be received for information and that the inaugural council minutes of November 15, 2022 be adopted.

That Council of the Township of Perth South does hereby appoint the following members to sit on the Court of Revision for the Van Nes Municipal Drain: Deputy Mayor Sue Orr, Councillor Robert Wilhelm, and Councillor Jaime Martin.

That the Council meeting recess at 9:34 a.m. in order to convene a Court of Revision relating to the McEwan Municipal Drain.

That the Court of Revision for the McEwan Municipal Drain - Zwoagas Crossing does hereby accept the recommendations of Brandon Widner of Spriet Associates and further does hereby confirm the drainage assessments as outlined in the Assessment Schedule dated October 13. 2022.

That the Court of Revision relating to the McEwan Municipal Drain 2022 is adjourned and the Council meeting reconvenes at 9:37 a.m.

That Council for the Township of Perth South accepts the recommendation of Brandon Widner of Spriet Associates to award the tender for the McEwan Municipal Drain - Zwoagas Crossing to DeJong Excavating in the total amount of $26,500.00 plus HST.

That the report for the Van Nes Municipal Drain 2022, as prepared by Stephen Brickman of Headway Engineering, in accordance with Section 42 of the Drainage Act be received and adopted.

That the Court of Revision hearing to consider the Assessment Schedule for the Van Nes Municipal Drain 2022 be scheduled to be held on January 17, 2023 at 7:00 p.m.

That the Drainage Engineer be authorized to call for tenders for the construction of the Van Nes Municipal Drain - with a closing date of February 1, 2023 at noon.

THAT the Council of the Township of Perth South receive the report entitled Severance Application File B34/22, submitted by Kathryn M. Ritsma on behalf of Dale Rae Meadows and Joan Viola Meadows for lands described as Lot 1, Concession 8, Downie Ward, Township of Perth South (3218 Road 112); AND THAT Perth South Council recommend that the County of Perth Land Division Committee APPROVE Severance Application File B34/22, submitted by Kathryn M. Ritsma on behalf of Dale Rae Meadows and Joan Viola Meadows, subject to the conditions listed in the report.

Nes That the Chief Building Official update report for November 2022 be received for information.

That the accounts payable listing dated December 2, 2022 for the period of November 12 to December 2, 2022 in the amount $104,610.32 be approved.

THAT the Report regarding the Draft Asset Retirement Obligations Policy, dated December 6, 2022, be received for information.

That Council receives the 2023 Ontario Municipal Partnership Fund update for information.

THAT the Report regarding an Update on Planning Applications, dated December 6, 2022, be received for information.

That the Council of the Township of Perth South receive the Enbridge Gas Franchise Agreement Report for information; and that the Council of the Township of Perth South approve the draft by-law and franchise agreement attached hereto and, following second reading, authorize the submission thereof to the Ontario Energy Board for approval pursuant to the provisions of Section 9 of the Municipal Franchise Act; and, That the Council of the Township of Perth South request the Ontario Energy Board make an Order declaring and directing that the assent of the municipal electors to the attached draft by-law and franchise agreement pertaining to the Corporation of the Township of Perth South is not necessary, pursuant to the provisions of Section 9(4) of the Municipal Franchises Act.

That Council receives the report entitled Request to Abandon a Portion of the Schabel Drain and further that Council approves the Request to Abandon a Portion of the Schabel Drain and directs staff to circulate notice to the affected property owner regarding the request to abandon a section of this drain as per Section 84(1) of the Drainage Act.

That Council sends a letter of support in regards to Stratford's resolution requesting funding and support for Via Rail services

That By-law 50-2022 being a by-law for drainage works known as the Van Nes Municipal Drain 2022 be given first and second readings.

Nes That By-law 51-2022 being a by-law to authorize entering into a franchise agreement with Enbridge Gas Inc. be given first and second readings.

That By-law 52-2022 being a by-law to adopt, confirm and ratify matters dealt with by resolution of the Township of Perth South be given first, second, and third readings, and be properly signed and sealed.
